NAB sells 9 properties without telling family!

The National Australia Bank (NAB) is selling 9 blocks of land owned by a Broadbeach Waters man without notifying him or his family. He plans protests at NAB branches to inform the public.

The owner of the properties, Paul Herman, said he suspects fraud and that the NAB is selling the land quickly to avoid a compensation claim. 5 properties are on Russell Island and 4 properties are on Macleay Island. Mr Herman said NAB Portfolio Manager Debbie Cram confirmed in a conversation with him on February 28 that NAB had planned to inform him of the sales after they sold his properties.

“The NAB is refusing to provide most of my personal information in breach of the Privacy Act. When I asked for my information they just fast tracked the sale of the properties,” Mr Herman said. “NAB sent me a letter claiming they don't have any of my personal information.

NAB lent me $650,000 on vacant land with no income, at 80% Loan to Value Ratio.”   “I presume the NAB destroyed my Loan Application Form because they fraudulently altered it after I signed. This was common practice” Mr Herman said.

This type of predatory lending was common practice according to Ms Denise Brailey president of the BFCSA (Banking & Finance Consumers Support Assoc inc).

Mr Herman said that at the recent Senate enquiry into ASIC (the Senate Committee will table its report on the 26-6-14), evidence was given of a widespread practice of financial institutions fraudulently doctoring loan application forms. “Later, when the borrower can’t pay, they are evicted from their home and bankrupted,”

Complaints were lodged with the Financial Ombudsman Service (FOS) but they refuse to intervene. Mr Herman asked “is FOS corrupt, employing NAB staff to get rid of legitimate complaints of maladministration?” At the Senate enquiry there were many complaints that ASIC & FOS do nothing.

Tasha Keys, Unhappy Banking advocate said “FOS is not stopping the Banks selling properties, when there has not been proper enforcement action. FOS aren’t doing their job. FOS is not being transparent with complainants that they are operating hand in hand with the banks.”

In recent court action brought by an elderly Sydney couple, their loan was reduced by 75 per cent. “Also compensation can be paid if the bank has bankrupted you,” Mr Herman said. “People have worked their whole lives and have had their nest egg wiped out by the banks. FOS is supposed to help these people.”

Mr Herman recommends that people ask for their loan application forms before they are destroyed by the bank. The Privacy Commissioner can force them to provide these documents.

Mr Herman has asked for whistleblowers to come forward and report fraud to the police. “ASIC has a program to protect whistleblowers,” he said. “People need to take a stand and work together against predatory practices by NAB and other banks.”

Mr Herman wrote to NAB CEO Cameron Clyne on May 9 asking if “NAB was too big to obey the law” and if he was going to do anything about fraud, but has not heard back. “I wonder if the CEO is asleep at the wheel, given that he has resigned and will get his multi-million dollar golden handshake in a few months,” Mr Herman asked. “The record profits at NAB come at the expense of ethics.”

NAB doesn’t care about customers because they just made a record profit. More take, less give!

NAB just spends a couple of million on a feel good advert and customers stay for life.

We will use documented evidence of National Australia Bank’s fraud to expose the poor values, ethics, lack of integrity and criminally fraudulent behaviour. The public needs to be warned about predatory lenders.

Don't get angry, get justice. Change to smaller bank. Find a better deal.
